While the number of animal attacks against humans is still relatively low, reports indicate that Texans are more likely to have a fatal encounter than any other state. The data compiled in the last 20 years by the disease control center shows that Texas only averages 26 deaths a year due to animal attacks.

The Texas Legislature approved in 2007, allows victims of dog attacks to hold owners responsible for  injuries or death caused by their dogs.


One Bite Rule in Texas

The responsibility of dog owners is based on negligence. The law of responsibility for a dog bite is based on the rule of "one bite" that establishes that a victim of dog bite can recover compensation for their injuries if :


  • The attack was unprovoked.

  • The dog involved had previously injured someone.

  • The dog knew the dog was aggressive and failed to take reasonable steps to prevent another attack.
